Abstract

ABSTRACT: This study analyzes the legal and humanitarian impacts resulting from the lack of formal recognition of the category of environmentally displaced persons or refugees at the international level. It begins with the observation that climate change and socio-environmental disasters have forced entire populations to relocate, without specific legal instruments guaranteeing them effective protection. The central problem of the research is the disharmony between the international legal system and the social reality experienced by these migrants, which leads to gaps in social (re)inclusion and the realization of basic human rights. The general objective is to analyze the legal and humanitarian conditions affecting environmentally displaced persons, while the specific objectives involve identifying gaps in international regulations and discussing the social implications of the exclusion of these populations. The methodology used is qualitative in nature, based on bibliographic and documentary research, supported by international organizations such as the Organization of American States (OAS) and the Inter-American Commission on Human Rights (IACHR). It was found that the lack of specific legal recognition limits access to fundamental rights, requiring the adoption of humanitarian reception policies and the creation of complementary international protection mechanisms.
