Abstract

O PRESENTE ARTIGO CIENT�FICO VISA TRATAR ASSUNTOS CONCERNENTES AO INSTITUTO DA ALIENA��O FIDUCI�RIA DE IMÓVEIS, DISCIPLINADA PELA LEI N�º 9.514 DE 20 DE NOVEMBRO DE 1997. TENDO NOTADO-SE QUE AS GARANTIAS PRESENTES NO NOSSO ORDENAMENTO JUR�DICO J� NÃO MAIS SATISFAZIAM A SOCIEDADE INDUSTRIALIZADA, DEVIDO A GRANDE MORA NA EXECU��O DAS MESMAS E OS ALTOS CUSTOS, INIBINDO O BOM FUNCIONAMENTO DO MERCADO, PERMITIU-SE ENT�O A CRIA��O DA ALIENA��O FIDUCI�RIA DE IMÓVEIS. ESSA MODALIDADE VEIO PARA SUPRIR DIVERSAS LACUNAS NO ORDENAMENTO BRASILEIRO, FUNCIONANDO COMO UMA ESP�CIE DE NEGÓCIO EM QUE H� DIREITO REAL SOBRE A COISA PRÓPRIA.
