MEDIA INFLUENCE IN THE FRAMEWORK OF CRIMINAL PROCEDURE LAW: THE PUBLIC CLAIM AS A JUSTIFIER OF PUNITIVE AND SANCTIONING MEASURES
Abstract
THE PRESENT WORK FOCUSES ON THE ROLE OF THE MEDIA IN CRIMINAL PROCEEDINGS AND ITS CONSEQUENCES IN CRIMINAL DECISIONS. THE AIM IS TO REVEAL AND ANSWER THE FOLLOWING ISSUE: HOW CAN THE MEDIA INFLUENCE A CRIMINAL TRIAL? FOR THIS, WE ARE GOING TO ANALYZE THE IMPORTANCE OF THE MEDIA IN CRIMINAL PROCEEDINGS; WHAT IS THE LIMIT OF THE MEDIA'S PERFORMANCE IN THE FORMATION OF CRIMINAL DECISIONS AND WHAT ARE THE CASES OF CLEAR INTERFERENCE BY THE MEDIA IN A TRIAL. ITS OBJECTIVES ARE TO DEMONSTRATE THE IMPORTANCE AND INFLUENCE OF THE MEDIA IN CRIMINAL PROCEEDINGS AND IDENTIFY ITS POSITIVE AND NEGATIVE ASPECTS IN CRIMINAL TRIALS TODAY, STUDY FROM A CRITICAL PERSPECTIVE THE MEDIA INFLUENCE AND ITS EFFECTS ON CRIMINAL PROCEEDINGS, DISCUSS THE LIMIT AND MANNER THE ROLE OF THE MEDIA IN COURT DECISIONS, AND ANALYZE CASES IN WHICH THERE IS CLEAR INTERFERENCE BY THE MEDIA IN THE PROCEDURAL PHASE. THE METHODS USED IN THIS WORK ARE BIBLIOGRAPHIC AND DOCUMENTARY RESEARCH, AS IT INCLUDES SURVEYS OF ALL BIBLIOGRAPHIES THAT HAVE BEEN PUBLISHED IN THE FORM OF BOOKS, PERIODICALS, ARTICLES AND CONFERENCE PROCEEDINGS. TO RESPOND TO THE PROBLEM, CRIMINAL CASES WERE HIGHLIGHTED THAT WILL SHOW OBVIOUS INTERVENTION BY THE MEDIA, WHICH CAUSED A SIGNIFICANT IMPACT IN RESPONSE TO THE PUBLIC CLAMOR FOR THE APPLICATION OF PUNITIVE MEASURES.
